These Terms and Conditions (“Terms”) govern your use of flycharmny.com (the “Site”) and the helicopter tour and charter services provided by Charm City Aviation LLC (“Charm Aviation,” “we,” “us,” or “our”). By using the Site or booking a service, you agree to these Terms.

Services

Charm Aviation operates helicopter tours and private charter flights departing from Downtown Manhattan Heliport. Service availability, routes, and pricing are subject to change. All flights are subject to weather conditions and Federal Aviation Administration regulations.

Bookings

Bookings are processed through our booking partner Xola. All payment terms, cancellation policies, and refund policies for individual tour bookings are described at the time of booking and in your booking confirmation. By completing a booking, you agree to those booking terms in addition to these general Terms.

Weather and Cancellations

Helicopter operations depend on weather conditions. We reserve the right to delay, reschedule, or cancel any flight when weather or operational safety concerns require it. If we cancel a flight, we will offer to rebook you for a future available time or, where applicable, issue a refund per the booking policy in effect at the time of your reservation. We are not liable for incidental costs such as travel, accommodations, or other arrangements affected by a weather cancellation.

SMS Messaging Program

By opting in, you consent to receive text messages from Charm Aviation. The program is described below.

• Program name: Charm Aviation SMS
• Program description: Charm Aviation sends SMS messages to consenting users for the following purposes: responding to missed inbound calls, notifying you of weather-related flight rescheduling, and sending post-flight follow-up requests.
• Message frequency: message frequency varies. You will receive messages only when there is a relevant operational or follow-up reason. Typical volume is between 1 and 5 messages per month per consenting user.
• Message and data rates: standard message and data rates may apply, depending on your wireless carrier and mobile plan.
• Opt out: to stop receiving messages at any time, reply STOP to any message. You will receive a confirmation that you have been unsubscribed. To resubscribe, reply START.
• Help: for assistance with the SMS program, reply HELP to any message or contact us at [email protected].
• Carrier disclaimer: wireless carriers are not liable for delayed or undelivered messages.

By providing your phone number and opting in (whether through our booking flow, by responding to a missed call, or by replying with an opt-in keyword), you agree to receive SMS messages from Charm Aviation consistent with this program description.

Limitation of Liability

To the maximum extent permitted by law, Charm Aviation is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services. Our total liability for any claim arising from a tour or charter booking shall not exceed the amount you paid for that booking.

Indemnification

You agree to indemnify and hold Charm Aviation harmless from any claims, damages, or expenses arising from your violation of these Terms or your use of our services in violation of applicable law.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws provisions. Any dispute arising under these Terms shall be brought in the state or federal courts located in New Jersey, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of our services after a revision constitutes acceptance of the updated Terms.
